These are the rules for using the Burger Prime app and website ("the Service"). By creating an account, placing an order, or just browsing, you're agreeing to these terms. If you don't agree, please don't use the Service.
"Burger Prime", "we", or "us" means Burger Prime, based in Nellore, Andhra Pradesh, India. "You" means the person using the app.
1. Your account
- You need to be at least 18 years old (or have a parent's permission) to create an account.
- Keep your email, password, and phone number accurate. We use them to send you order updates and recovery links.
- Your account is yours — don't share it. You're responsible for anything that happens through your login.
- We may ask for extra verification (like a 6-digit code to your email) when you turn on Two-Factor Authentication in Settings. This protects your account from unauthorised access.
2. Placing orders
- When you place an order, you're making an offer to buy. The order is confirmed once the restaurant accepts it and you receive an in-app confirmation.
- Menu items, prices, and availability can change without notice. We'll always show the current price at checkout before you pay.
- Taxes (GST) and delivery fees are shown on the checkout screen before you place the order. Delivery fees depend on your cart total — see "Delivery" below.
- We reserve the right to refuse or cancel an order if we suspect fraud, if an item is out of stock, or if we can't deliver to your address.
3. Payments
- We accept Cash on Delivery (COD) and online payments through Razorpay (Visa, Mastercard, RuPay, UPI, wallets, net banking).
- All prices are in Indian Rupees (₹).
- For online payments, Razorpay processes your card details directly — we never see or store your full card number.
- If your payment fails, your order won't be placed. You'll see an error message and can try a different method.
4. Delivery
- We deliver within our serviceable area around Nellore. The app will only let you enter an address we can reach.
- Delivery fee: ₹40 flat on orders between ₹100 and ₹499. Orders at or above ₹500 get free delivery. The cart screen shows a live progress bar so you know exactly how much more to add.
- Estimated delivery times are estimates, not promises. Weather, traffic, and kitchen load can change them.
- Contactless delivery is available on prepaid orders only. If you select it, our delivery partner will leave your order at your door and confirm via the app. Cash on Delivery requires an in-person handoff so we can collect the payment.
- Once the order is marked out for delivery, you can confirm receipt yourself via the Mark as Delivered button on the Order Tracking screen.
5. Cancellations and refunds
- You can cancel your order for free within 3 minutes of placing it, right from the Order Tracking screen. After that, the kitchen begins preparing your food and cancellation isn't guaranteed.
- For any changes or cancellations after the 3-minute window, email support@burgerprime.in or call +91 77021 42830. We'll do our best but can't promise a refund once your food is being cooked.
- Refunds for successful cancellations are processed through the original payment method and typically arrive within 5–7 business days for cards, 24 hours for UPI, and instantly for wallet payments.
- If something's wrong with your order (missing items, cold food, wrong delivery), contact us within 24 hours and we'll make it right — a refund, a credit, or a replacement as appropriate.
6. Promo codes and offers
- Promo codes are single-use unless stated otherwise, can't be combined with other offers, and have no cash value.
- We can modify or cancel a promotion at any time if we suspect misuse.
- "Free delivery over ₹500" is not a promo code — it's built into pricing and applies automatically.
7. Acceptable use
Don't do any of this:
- Impersonate someone else, use fake payment details, or create fake accounts
- Harass, threaten, or abuse our staff, delivery partners, or other users
- Scrape, copy, or republish our menu, prices, or content without permission
- Use the app to break any law
- Try to reverse-engineer, disrupt, or overload the Service
We can suspend or close accounts that break these rules.
8. Intellectual property
The Burger Prime name, logo, photography, and app design belong to us. You can use the app as intended — browsing, ordering, sharing your own order receipts — but you don't get ownership of any of our content.
9. Limitation of liability
- The Service is provided "as is". We work hard to keep it accurate and available, but we don't guarantee it will be error-free or always online.
- To the extent permitted by Indian law, our total liability for any claim related to an order is limited to the amount you paid for that order.
- We're not liable for indirect losses (like a missed event because your food was late). If the issue is our fault, we'll refund, replace, or credit — whichever is fair.
10. Changes to these terms
We may update these terms from time to time. When we do, we'll change the "Last updated" date at the top and, for significant changes, send you a notification in the app or by email. Continuing to use the Service after a change means you accept the updated terms.
11. Governing law
These terms are governed by the laws of India. Any disputes will be handled by the courts in Nellore, Andhra Pradesh.
